Welcome to Hoplite's Terms of Service. In this document, "we," "us," and "our" refer to Hoplite, the Minecraft server, webstore, and related services operated by SpeedSilver Limited. "You" refers to any individual accessing or using our services.

1.1 Definition of Terms In these Terms of Service ("Terms"), the following definitions shall apply: - "Hoplite" refers to the Minecraft server, webstore, and related services operated by SpeedSilver Limited. - "User" or "You" refers to any individual accessing or using Hoplite's services. - "Services" refers to the Minecraft server, webstore, and any other related offerings provided by Hoplite.

1.2 Acceptance of Terms and Conditions By accessing or using Hoplite's services, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, you must not access or use the services.

1.3 Scope of Services Hoplite offers a Minecraft server that users can play on for free and a webstore where in-game items can be purchased. These Terms govern the use of all related services.

The Hoplite Minecraft Server and this website are not official Minecraft services and are not approved by or associated with Mojang or Microsoft.

3.2 Protection of Intellectual Property All content, trademarks, logos, and other intellectual property related to Hoplite's services are the exclusive property of SpeedSilver Limited or its licensors and are protected by intellectual property laws.

4. Modification of Terms

4.1 Right to Amend Terms Hoplite reserves the right to modify, amend, or replace these Terms at any time. Any changes will be posted on Hoplite's website, and it is your responsibility to review the Terms regularly.

4.2 User Responsibility to Review Changes Your continued use of Hoplite's services after any changes to the Terms constitutes your acceptance of those changes. If you do not agree to the updated Terms, you must cease using the services.

5. In-Game Items and Purchases

5.1 Description of Items Hoplite offers various in-game items for purchase, including but not limited to VIP ranks, gems, and cosmetic items. These items are virtual and have no real-world value.

5.2 Restrictions and Limitations Certain in-game items may be subject to restrictions or limitations. It is your responsibility to understand these conditions before making a purchase. All sales are final, and no refunds will be provided.

6. Age Restrictions and Parental Consent

6.1 Access by Minors Hoplite's services are intended for a general audience. Users under the age of 18 must obtain parental or guardian consent before making any purchases.

6.2 Parental Guidance Parents and guardians are encouraged to monitor and supervise their children's use of Hoplite's services and ensure compliance with these Terms.

7. Governing Law

7.1 Applicability of UK Law These Terms and your use of Hoplite's services are governed by the laws of the United Kingdom, without regard to its conflict of law principles.

7.2 Jurisdiction Any legal action or proceeding related to Hoplite's services shall be brought exclusively in the courts of the United Kingdom.

8. Prohibited Actions and Content

8.1 Specific Prohibitions You are prohibited from engaging in actions that may harm, disrupt, or otherwise negatively affect Hoplite's services or other users. This includes, but is not limited to, hacking, cheating, using abusive language, or creating or distributing malicious content.

8.2 Enforcement Measures Hoplite reserves the right to take appropriate action against any user found to be in violation of these prohibitions, including suspension or termination of access to the services.

9. Discord Integration

9.1 Linking of Accounts Users may link their Discord account with their Minecraft account for enhanced functionality and community engagement.

9.2 Data Storage and Usage Information collected through Discord integration, such as Discord ID and Minecraft username, will be used in accordance with Hoplite's Privacy Policy and applicable laws.

10. Liability Limitations

10.1 Exclusion of Certain Damages To the fullest extent permitted by applicable law, Hoplite shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses, arising out of or related to your use of the services.

10.2 Waiver of Legal Actions You agree to waive any legal actions against Hoplite that are not initiated within one (1) year after the cause of action arises.

11. Refund Policy

11.1 No Refunds All purchases of in-game items and other virtual goods are final and nonrefundable. Please review your selections carefully before making a purchase.

11.2 Charge-Back Consequences Any charge-backs or disputes initiated against Hoplite may result in immediate termination of your access to the server.

12. Content Creation and Streaming

12.1 Permissions for Content Creators Users are permitted to create and stream content related to Hoplite's services, provided they comply with these Terms and all applicable laws.

12.2 Compliance with Rules Content creators must not use or promote cheats, hacks, or other prohibited actions. Any content that violates these Terms may be subject to removal or other enforcement measures.

13. Voice Chat Policy

3.1 Collection and Use of Voice Records When using voice chat features, Hoplite may collect and use heavily encrypted voice records for moderation purposes. Users must consent to this collection and use.

13.2 Privacy Settings Users have the option to switch to private settings in voice chat. Voice logs for users on Friends & Party Members options are not logged.

14. Subscription Services

14.1 Details of Monthly Subscriptions Hoplite offers subscription services such as the "VIP" rank, providing in-game benefits. These subscriptions can be canceled at any time.

14.2 Cancellation Policy Users are responsible for managing and canceling their subscriptions. No refunds will be provided for partially used subscription periods.

15. Dispute Resolution

15.1 Process for Resolving Disputes Any disputes arising out of or related to these Terms or Hoplite's services shall be resolved through good faith negotiations between the parties.

15.2 Alternative Dispute Resolution Options If negotiations fail, the parties may agree to resolve the dispute through mediation or arbitration in accordance with the laws of the United Kingdom.

16. User Agreement

16.1 Changes to Prices or Values Hoplite reserves the right to change the prices or values of any in-game items, subscriptions, or other virtual goods at any time without prior notice.

16.2 Indemnification Clause You agree to indemnify and hold harmless Hoplite, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your violation of these Terms or your use of the services.

17.1 Support Ticket System Users may also utilize the support ticket system on Hoplite's Discord server; discord.gg/hoplite for assistance with technical or account-related issues.

18.1 Reference to Privacy Policy Your use of Hoplite's services is also governed by Hoplite's Privacy Policy.

18.2 Commitment to Privacy Hoplite is committed to protecting your privacy and will handle your personal information in accordance with the Privacy Policy and applicable laws.

19. Server Rules and Community Guidelines

20.1 Grounds for Account Termination or Suspension Hoplite reserves the right to terminate or suspend your access to the services for violations of these Terms or any other misconduct.

20.2 Appeal Process Users may appeal a suspension or termination by contacting Hoplite's support team in Hoplite's Discord server; discord.gg/hoplite and providing relevant information.

21. Severability

21.1 Enforceability of Provisions If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

22. Entire Agreement

22.1 Complete Understanding These Terms, together with Hoplite's Privacy Policy and any other legal notices or agreements published by Hoplite, constitute the entire agreement between you and Hoplite regarding the use of the services.

23. Force Majeure

23.1 Unforeseen Events Hoplite shall not be liable for any failure to perform its obligations under these Terms if such failure results from any cause beyond Hoplite's reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, or governmental actions.
